Welcome to iShifa. These Terms of Service ("Terms") are a legal agreement between you and Priyo Health Inc. ("iShifa," "we," "us," or "our") governing your access to and use of our website, Patient Portal, Doctor Portal, and related services (collectively, the "Services").
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. A parent or legal guardian may manage records on behalf of a minor in their care. Doctors must hold a valid BMDC registration and provide accurate professional credentials for verification.
2. Your Account
- You are responsible for keeping your login credentials confidential.
- You agree to provide accurate, current, and complete information.
- You are responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorized use or security breach.
3. Medical Disclaimer
iShifa is a health information management platform. It does not provide medical advice, diagnosis, or treatment. AI-assisted diagnostic features are informational tools to support — not replace — the judgment of qualified healthcare professionals. Always seek the advice of a licensed physician for any medical condition. In an emergency, contact your local emergency services immediately.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful, fraudulent, or harmful purpose.
- Upload false, misleading, or unauthorized health information.
- Access, tamper with, or attempt to breach accounts or systems that are not yours.
- Reverse engineer, scrape, or disrupt the Services or their infrastructure.
- Impersonate any person or misrepresent your affiliation or credentials.
5. Health Records & Content
You retain ownership of the health records and content you submit. By using the Services, you grant iShifa a limited license to host, process, and display that content solely to provide the Services to you and your authorized care team. You are responsible for the accuracy of the information you provide.
6. Doctor Responsibilities
Healthcare providers using the Services agree to act within their professional licensure, comply with applicable medical and ethical standards, and maintain the confidentiality of patient information accessed through the platform.
7. Intellectual Property
The Services, including software, design, logos, and content created by iShifa, are owned by Priyo Health Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
8. Service Availability
We strive to keep the Services available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Services at any time, with notice where practicable.
9. Limitation of Liability
To the fullest extent permitted by law, iShifa and Priyo Health Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. The Services are provided "as is" and "as available" without warranties of any kind, express or implied.
10. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms or use the Services in a way that risks harm to others. Provisions that by their nature should survive termination will continue to apply.
11. Governing Law
These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh.
12. Changes to These Terms
We may update these Terms from time to time. We will post the revised version here and update the "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
